THE FOLLOWING DESCRIBES THE TERMS ON WHICH PORN CLUB CARD OFFERS YOU ACCESS TO OUR SERVICES.

This user Terms of Service (the "Agreement" or "User Agreement") describes the terms and conditions applicable to your use of our services at https://www.pornclubcard.com (alternatively "We" or "Us" or "The Club"). We may amend this Agreement at any time by posting the amended terms on our site. Except as stated below, all amended terms shall automatically be effective immediately after they are initially posted on our site. This Agreement may not be otherwise amended.

You must read, agree with and accept all of the terms and conditions in this User Agreement and the Privacy Policy, which include those terms and conditions expressly set out below and those incorporated by reference, before you may become a member of our website. We strongly recommend that as you read this User Agreement, you also access and read the information contained in the other pages and websites referred to in this document, as they may contain further terms and conditions that apply to you as a user. Please note that underlined words and phrases are links to these pages and websites.

1.Membership Eligibility.
Our services are available only to individuals who can form legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors or to temporarily or indefinitely suspended members. You must be at least eighteen (18) years old [21 years old in some locations] and must not be prohibited by law from viewing sexually explicit material.  By entering this website, you are affirmatively stating that you wish to view adult content of sexually explicit nature.  If you do not qualify, do not use our services.

2.Transfer. 
Your account, points and User Name may not be transferred or sold to another party.

3.Fees. 
The fees for membership of websites participating in Porn Club Card are posted on those individual websites.  The Club is not responsible for setting the membership fees of any website and we cannot refund any purchases you make.  If you have any concerns with a specific website after you have made your purchase, you must contact that website or its billing company directly.  Do not contact The Card. You are responsible for paying all fees associated with using our service and our website and all applicable taxes.

4.Membership sites. 
PornClubCard is not responsible for the content or management of any websites that you may join.  If you have questions or issues with a site you have joined, your only recourse is to contact that site directly.

5.Joining websites without going through PornClubCard.com. 
In order to earn points from PornClubCard, you must join by clicking on the link to the membership site located on PornClubCard.  If you do not click on our link, your membership purchase will not be credited and you will not earn any points.

6.Points. 
Each purchase of a membership to a website through PornClubCard will be awarded points.  The number of points varies with each site.  You agree the number of points awarded will be determined following the approval of your membership and may change from the time you initially join to the time your membership is finally approved.

7.Recurring Memberships. 
On those websites that notify us when you renew your membership, we may award additional points for membership renewals.  For websites that do not notify us of your renewal, no points will be awarded.

8.Redemption. 
The number of points required for redemption and free membership will vary from website to website and you agree that we may adjust the number of points required from time to time and from website to website.

9.Fraud.
Without limiting any other remedies, we may suspend or terminate your account if we suspect that you have engaged in fraudulent activity in connection with our site.

10.Breach.
Without limiting other remedies, we may immediately issue a warning, temporarily suspend, indefinitely suspend or terminate your membership and refuse to provide our services to you:
a.if you breach this Agreement or the anything this agreement incorporates by reference.
b.if we are unable to verify or authenticate any information you provide to us or our third party billers; or
c. if we believe that your actions may cause legal liability for you, our users or us.
d.If you engage in improper charge back or refund requests for memberships you purchase

11.Use.
Without limiting other remedies, we may immediately issue a warning, temporarily suspend, indefinitely suspend or terminate your membership and refuse to provide our services to you for any reason with or without cause.

12.No Warranty.
WE PROVIDE OUR WEB SITE AND SERVICES "AS IS" AND WITHOUT ANY WARRANTY OR CONDITION, EXPRESS, IMPLIED OR STATUTORY. WE SPECIFICALLY DISCLAIM ANY IMPLIED WARRANTIES OF TITLE, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. Some jurisdictions do not allow the disclaimer of implied warranties, so the foregoing disclaimer may not apply to you.

13.Liability Limit.
IN NO EVENT SHALL WE BE LIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN CONNECTION WITH OUR SITE, OUR SERVICES OR THIS AGREEMENT (HOWEVER ARISING, INCLUDING NEGLIGENCE). Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation or exclusion may not apply to you

14.Indemnity.
You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, officers, directors, agents, and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of this Agreement or the documents it incorporates by reference, or your violation of any law or the rights of a third party.

15.Legal Compliance.
You shall comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of our service.

16.Notices.
Except as explicitly stated otherwise, any notices shall be given by email to us at: issues@pornclubcard.com or to the email address you provide to us during the registration process (in your case). Notice shall be deemed given 24 hours after email is sent.
